Selling Checklist

If you are thinking of selling what should you do to prepare to market your property?

The obvious answers are to do research on prices in your area, spend some time making sure the home presents well, and organise a home open. These are all fine ideas but in your haste to get it sold don't overlook important legalities.

Even if you are selling through a real estate agent, for your peace of mind do some checks on the property yourself. You may well have been living in it for the last 12 years but do you know for certain that the patio is council approved or the septic tanks have been decomissioned?

We have provided a checklist below as a guideline.

Factors Affecting the Land
  1. Are there any proposals for the re-alignment, widening, or alteration of the level of any road adjoining the property?
  2. Have you received notice of any intention to resume the land or any part of it? Has any part of the land been resumed that you still have the use of.
  3. Are there any rights of way or restrictions of any kind affecting the property that are not registered on the Certificate of Title? (e.g. local council regulations on permitted use of the land)
  4. Is there any outstanding liability for the payment of dividing fences?
Utilities
  1. Is the property connected to mains gas?
  2. Is the property connected to underground power?
  3. Is the house connected to the main sewer?
  4. Is the property connected to septic tanks?
    i) Are there any disused septic tanks underground?
    ii)Have any septic tanks been decommissioned?
Improvements on the Land
  1. Are all the buildings, and any additions, constructed in accordance with, and approved by, the relevant authorities? (e.g. pergolas, enclosed patios, garages, pool/spa etc.)
  2. Was your home built by an owner builder within the last 7 years? Have you made alterations or additions to the property which required a building licence?
    i) If the building licence was issued within the last 7 years and the cost of the alterations was more than $12,000, have you effected the statutory home indemnity insurance?
  3. Is there a swimming pool or outdoor spa
    If ‘Yes’; i) What is the construction?
    ii) Is it a chlorine or salt pool?
    iii) Does the pool fence comply with the 2002 Building Amendment Regulations
    iv) When was the pool fence last checked by the local authority
    v) Is the cleaning and filtration system in working order?
    vi) Is there any pool cleaning equipment not included in the sale
  4. Is the garden reticulated?
    If ‘Yes’; i) is it fully or partly reticulated?
    ii) Is the reticulation system working?
    iii) How is it operated?
    iv) What type is the reticulation system?
  5. If there is a bore:-
    i) is it shared with a neighbour
    ii) is there a written agreement with neighbours, about running costs?
Fixtures and Fittings

13. Do you intend to remove any fixture or fitting, currently nailed or screwed to the premises, that a Buyer
would normally expect to be included with the purchase (e.g. light fitting, dishwasher, T.V. aerial, curtains,
clothes hoist, water feature, etc.)


Plant & Equipment

14. Will the following items be in order at settlement?
i) All mechanical devices including all doors and windows etc.
ii) All electrical fittings and devices including lighting, power points, sensors indoors and out etc
iii) All gas fittings including bayonets, igniters etc
iv) All plumbing and fittings including WC’s, showers, drainage, tap fittings, roof guttering, soak wells
v) All Fences
vi) All locking keys and or electronic devices for all doors, windows etc
